In the Consistoriall Place of the Cathedrall kirk of Murray the last day of the moneth of May the yeir of god ane thousand four hundreth nynty and nyne yeiris, We Master Johne Spens, Persone of Davoy and Officiall of Murray, Thomas Lesly, chanoune of the said Cathedrall kirk of Murray and Prebendar of Kyngusy in the samyn and James Douglas of Peitindreche, arbitouris and amabilles compositouris indeferantlie chosin betwix ane venerabill fadir in god, Robert, be the permissione of god priour of the monasteri of Pluscardin within the diocese of Murray, and the convent of the samyn, on the tane part, and ane noble man James of Dunbar of Cumnok, knycht, on the tother part, for the conselling gud treting and finall deliveranis of all and sindre debatis questiones querellis actionis causis and controversiis undirwritin movit betwix the said parteis and actionis aganis utheris, the quhilkis parteis beand oblist and sworn upon the haly evangelis be thair gret athis to stand and abyd at us finalie til undirly our consellis decretis sententis ordinancis and deliverance in the saidis debatis, and we takand on us to give it furthe eftir our wittis the resonis richtis and allegatiounis be baithe the said parteis be us sene undirstandin and considerit, and that with beand riplie advisit hafand god before the yiis we decreit giffe sentence and finalie deliveris for us all in ane voce:- In the first that the said Schir James Dunbar knycht sal give oure all the rychtis that his fader or he or thair airis had or may have in or to the landis of Estir Fochabris and Westir Fochabris Ordedawrathe and Aldchaiss with thair pertinentis lyand within the sheriffdome of Elgin togidder witht all charteris, letteris of reversionis, instrumentis, evidentis and documentis had or may be gotten thairupone to the said Priour convent and place of Pluscardin and sal deliver to thame the Reversione of Estir Fochabris and Wester Fochabris new and auld Ordedawrathe and Aldchais and sal make him and his convent beforesaid assignais to lowis the landis of Estir Fochabris and Aldchais that Walter Innes airis has in wedset.

In the year 1567, the lands of Upper Manbeen belonged to Hieronymus Spens, as appears by a feu charter granted in his favour by James Thornton, precentor of Moray, of Church lands in Alves, with consent of the Bishop, dated 16th August, 1567. It is probable the lands of Upper Manbeen continued in possession of the family of Spens, or Spence, up to the early part of last century. There is a curious old well on the property, with the initials H. S., and the date 1699 upon it cut in stone, with the legend, " Ex dono Dei bibite gratis." This well was probably made by the then proprietor, and the initials are stated to be those of Hieronymus Spence. It is many years since we visited this pleasant spot. It is much to be regretted that the noble proprietor does not have it repaired and enclosed, and some trees or shrubs planted about it. It has evidently been a scene once dear to the owners of former ages, and a pleasant retreat from the bustle of the world.

9. Robert Spens of Tulloch was born in 1620 in Tulloch, Moray, Scotland. He was the son of James Spens Spence of Kirktoun (8) and Agnes Tulloch of Alves.
Robert died in Tulloch.
Robert Spens of Tulloch (Morayshire) and his son of George Spens of Tulloch, were among those who were called to testify regarding the details of the Burning of Frendraught on behalf of the Scottish Privy Council on the 25th of January 1630.
The Burning of Frendraught was a turning point in the clan warfare between the house of Crichton of Frendraught and the the Marquis of Huntly, the head of the house of Gordon.
On 3rd February 1631, the Privy Council permitted Robert Spens of Tulloch, and others involved in the Burning of Frendraught to return to their own homes to attend to their own affairs.
On 1st February 1631, Robert Spens of Tulloch, gave a deposition to the Privy Council on the Burning of Frendraught:
Robert Spense, sworne and demandit if he knowis Patrik Barclay, deponis he knowis him and that he mett with him laitlie who reported to the deponer that the Fryday before the burning of Frendraught, he being comeing out of Turreff and forgaddering with Robert Wilsone, servitour to Johne Meldrum, Patrick Barclay, having demandit of Robert Wilsone quhat newes he had and if his maister wes satled with Frendraught, Robert Wilsone ansuerit that thay wer not aggreid and that within fours houres the heightest stane of Frendraught wald be the laighest. And deponis that the Laird of Haltoun wrett to the deponer with the pairtye it will cost me my life -. Quhairunto the lady ansuerit, 'thou is a unhappie las. be not fleed. byd be the thing thow hes said. i shall warrand the-. And deponis that Cristeane Chalmeris wes present showing a much quhen the lady spake the wordis. And deponis that quhen show wes comeing doun to the Counsaill, sho having said to the Laird of Frendraught, -Sir, I feare I gett evill if I go before the Counsaill, I pray yow, Sir, see that I gett no harme-; the Laird ansuerit, -I sall send four men with the, and if they will not serve I sall send sex men and thay will bring yow saulfelie bak-; and said to his servandis, -See for your lyffe that yow come not bak if yow bring hir not bak agane-. Demandit who caused hir mak the discourse aganis Pitcaple, deponis, that sho told George Spense that sho had hard all these speeches be report and that the Lady Frendraught and George Spence, the Weddingsday after sho come to the toun in the ladye chalmer, Cristeane Chalmer being present, they bad the deponer say that sho saw report, and particularlie that sho had gevin Richard Mowatt his supper that night he come home to Newmiln, and that sho should be in no danger for doing it, denys the same to be of veritie and denys that sho hard the lady or any other desyre Margaret Wode to speake ony thing bot the treuth. --
On the same day his father, George Spens of Tulloch, also gave deposition to the Privy Council:
--George Spense sworne and demandit if Margaret Wode said to him and the lady that sho had only hard by report the discourses aganis Pitcaple and that they bad hir say that sho had seene with hir eys that whiche sho had only hard, and speciallie anent the geving of Richard Mowat his supper, denyis the same to be veritie, and deponis upoun his oath that they never required hir to speake ony thing bot the treuthe, and that sho never spake sic words as sho depons tuicheing her leing.

Agnes de Spens of Tulloch married John Falconer of Tulloch Lord Phesdo Warden of the Scottish Mint in Phesdo, Midlothian. They had two sons. John was born in Tulloch, Perthshire, in 1620. He was the son of Archibald Falconer and Jean. John reached 62 years of age and died in Forres, Moray, on October 2, 1682. |

Sir James Falconer was born in August 1648. He was the oldest son and heir of Sir John Falconer, a Scottish nobleman, and his wife, Lady Agnes ("Spens" aka "Spence") Falconer.[1]
Sir James Falconer was educated in Edinburgh and admitted an advocate at the Scottish bar on January 6, 1674. He left the bar when a dispute arose about certain appeals but was re-admitted, January 8, 1676. His father had ceded his lands at Phesdo, Scotland, to his oldest son in 1672 (at James' marriage to Elizabeth Trent).
In November 1682, Sir John Falconer, one of the wardens of the Scottish Mint, on learning that he was to be pursued for malversation in office, suffered a massive heart attack and died suddenly at the family estate in Phesdo, Scotland.
After his death, the crown imposed a fine of five years and a half rent of his whole estate. Sir James, his son, whom the authorities held liable as his father's successor, and because he had earlier refused to pay a composition on his inheritance, was also fined in six years rents of his whole fortune.
Sir James Falconer was appointed an Ordinary Lord after the Glorious Revolution of 1688 that brought William & Mary to the English/Scottish throne. He took his seat in the House of Lords as Lord Phesdo, on November 1, 1689. He was nominated a Lord of the Justiciary, on January 27, 1690. He represented the shire of Kincardine, Scotland, in the Parliaments of 1703-4.[2]
Sir James Falconer married Elizabeth Trent, b: 7 Jan 1655, in 1672 in Scotland. The couple had 13 children:[3]

Yes, he was born about 1658, son of John Falconer of Tulloch (later of Phesdo), warden of the Scottish Mint, by his wife Agnes Spens, daughter of James Spens of Alves Kirktoun, Morayshire, by Agnes Tulloch, his wife.Patrick was apprenticed in 1675 to James Fall, merchant, of Edinburgh. In 1684, he went to New Jersey. I've traced all his male-line descendants downward and have his ancestry back in Scotland traced in my book, _Falconer of Halkerton_, published by Heritage Books, of Bowie, MD (see http://www.heritagebooks.com/http://www.heritagebooks.com/for more info).
He probably went to New Jersey because his kinsman David Falconar, a Quaker merchant, was a proprietor and brother-in-law to Robert Barclay, nominal governor of East New Jersey.Sir John Falconar, younger half-brother of David, was Master of the Mint in Scotland until ousted in a political struggle which began in 1682. New Jersey was a way out for Patrick, a younger son of John, warden of the mint.

85. James Spence M.D.; Surgeon; Professor; FRSE; PRCSE was born on Tuesday, March 31, 1812, in South Bridge Street, Edinburgh, Midlothian, Scotland. He was the son of James Spence Perfumer; Merchant in Edinburgh (82) and Jane Edwards.

SPENCE, JAMES (1812-1882), surgeon, son of James Spence, a merchant of Edinburgh, by his third wife, was born on 31 March 1812 in South Bridge Street, Edinburgh. He was educated in Galashiels, at a large boarding-school, and afterwards at the high school, Edinburgh. He entered the university of Edinburgh in 1825, and began to study medicine for the purpose of qualifying as an army surgeon. His medical studies were interrupted, and he was apprenticed to Messrs. Scott & Orr, an eminent firm of chemists, then carrying on business in Prince's Street, Edinburgh. He succeeded, however, in completing his medical education at the university and in the extramural school, and in 1832 he received the diploma of the Royal College of Surgeons, Edinburgh, having previously spent sometime in Paris studying anatomy and surgery. As soon as he was qualified he made two voyages to Calcutta in 1833 as surgeon to an East Indiaman. He afterwards returned to Edinburgh, where he had a severe attack of typhus fever. There he began to teach anatomy as the university demonstrator under Professor Alexander Monro tertius [q. v.], and in this occupation he continued for seven years. He resigned his post in 1842, and joined Drs. Handyside and Lonsdale in the extramural school of anatomy at 1 Surgeons' Square, to act as demonstrator in place of Dr. Allen Thomson [q. v.], who had been appointed to the chair of physiology in the university. There Spence took part in the lecture-room course of demonstrations on regional anatomy, as well as in the dissecting-room teaching. His teaching was greatly appreciated in the school, at that time the chief school of anatomy in Edinburgh. He was a remarkably dexterous dissector, and some of his beautiful preparations of the vascular system are still preserved in the university.
Spence, who was in surgical practice while teaching anatomy, left the dissecting-room in 1846, and gave lectures on his favourite parts of surgery. In 1849, on becoming a fellow of the Royal College of Surgeons, he lectured systematically on surgery, at first at High Schools Yards, adjoining the royal infirmary, where Robert Liston [q. v.] and James Miller [q. v.] had lectured, and, on the death of Richard Mackenzie in 1854, at the school at Surgeons' Hall. In 1864, on the death of Professor James Miller, he was appointed professor of surgery in the university. He had been appointed assistant surgeon to the Royal Infirmary in 1850, full surgeon in 1854, clinical lecturer in 1856, and he continued, as professor of surgery, to act as surgeon at the infirmary till his death. He was appointed surgeon in ordinary to the queen in Scotland in 1865, president of the Royal College of Surgeons of Edinburgh in 1867 and 1868, and member of the general medical council in 1881, representing there the Royal College of Surgeons of Edinburgh.
He died at 21 Ainslie Place, Edinburgh, on 6 June 1882, and was buried in the Grange cemetery, Edinburgh. A three-quarter length in oils was painted by James Irvine. It was etched by Durand of Paris, and a replica is in the possession of the Royal College of Surgeons at Edinburgh. The portrait was presented to Professor Spence on 18 July 1881, in the name of the medical profession of Great Britain, Ireland, and the Colonies.
He married, in 1847, the daughter of Thomas Fair of Buenos Ayres, by whom he had six sons and three daughters.
Spence must be reckoned among the great operating surgeons who have rendered Edinburgh famous throughout the world. Like Liston, Fergusson, and Syme, he had so intimate a knowledge of anatomy that every step in a difficult operation was foreseen. He was especially happy in his treatment of tracheotomy, herniotomy, urinary diseases, and amputations, yet he was essentially a conservative surgeon, and, like his great contemporary, Sir William Scovell Savory [q. v.], he maintained that, in skilled hands, the simple methods of the older school were preferable to, and gave as good results as, the more complicated system adopted by the disciples of the antiseptic school of Lister. After the death of James Syme in 1870 Spence became the leading consulting and operating surgeon, and occupied that position until his death.
He published: ‘Lectures on Surgery,’ plates, 4 pts. in 2 vols. 8vo, 1868-9-71; 2nd edit. 1875; 3rd edit. 1882. This is the work upon which Spence's reputation as a writer chiefly rests. He also contributed many papers upon anatomical and surgical subjects to various Scottish, English, and Irish scientific journals. 136. Henry Harry Spens Spence Prof. of Theology at St. Andrews University was born on September 10, 1714, in Edinburgh Parish, Edinburgh, Midlothian, Scotland. He was the son of James Spens of Kirktoun (32) and Anne Robertson.
Henry Harry was baptized in Edinburgh Parish. He died in St Andrews, Fife, on November 27, 1787, at the age of 73.
Spens, Henry [Harry] (1714-1787), Church of Scotland minister and classicist, was born Henry Spence on 10 September 1714 in Edinburgh, the son of James Spens of Kirkton of Alves, an Edinburgh writer to the signet who is credited with a broadside against the Jacobite rising of 1715. His mother was Anne Robertson. Educated at King's College, Aberdeen, where he graduated MA on 1 April 1730, Spens trained for the ministry and was licensed by the presbytery of Dalkeith on 3 October 1738. In November 1744 he was ordained to the parish of Wemyss, on the coast of Fife, where he served for thirty-five years. While there he is believed to have co-authored, with John Chalmers, minister of the nearby parish of Elie, a brief pamphlet titled An Inquiry Concerning a Plan of a Literary Correspondence (1751). In 1763 Spens produced the first English translation from the Greek of Plato's Republic, which was frequently reprinted from 1906 onward in the popular Everyman's Library edition. The original edition was published in Glasgow by Robert and Andrew Foulis, with a preface that was identified on the title page as 'a Preliminary Discourse concerning the Philosophy of the Ancients, by the Translator'. There Spens praises the ancients, and especially Plato, for joining philosophy with 'politeness', virtue, and religion. Writing of Socrates and Plato, he asserts that 'Divine Providence seems to have raised up these illustrious philosophers, to be advocates for virtue, and to give some check to the progress of prevailing corruption, and impiety' (The Republic of Plato, trans. H. Spens, 1763, xviii).
On 29 October 1765 Spens married Anne Duncan, the widow of a Captain Home RN. Their only child, James, was born on 1 October 1771 but died later that month. Spens was admitted to the chair of divinity at St Andrews on 29 December 1779 and remained there until his death in 1787. His connection with the moderate party in ecclesiastical affairs was an important factor in his selection for the chair. When promoting Spens's candidacy in a letter to London of 15 November 1779, William Robertson, the historian and leader of the moderates, wrote:
He is learned, decent, and worthy, and eminent for an uniform adherence to … moderate and rational principles both concerning Ecclesiastical and civil policy. … It is indeed of great importance to have a person of his character in such a station, at a time when a spirit of fanaticism and disorder, is spreading among our Order.

Robertson to Lord -, TNA: PRO, SP 54/47, fols. 364-5: Spens was then put up for moderator of the general assembly by the moderates, and on 25 May 1780 he secured that office in a significant test of party strength by narrowly defeating Sir Henry Moncreiff Wellwood, the popular party leader, 112 to 106. According to Scott he received an honorary DD degree from King's College, Aberdeen, on 1 October 1781, but he was already styled 'H. Spens, D.D.' on the title page of his translation of Plato's Republic in 1763. Spens was a non-resident member of the Royal Society of Edinburgh. He died on 27 November 1787.
